Mother, daughter found dead at Kain Ave. home, ex-husband held

ASHTABULA —  A mother and daughter are dead and the ex-husband is in police custody after a lethal domestic altercation over the weekend at 5012 Kain Ave., police said.

Family members discovered the owner of the ranch-style home, Amparo “Patty” Torres, 40, and her daughter, Hilda Delores Garcia Rodriguez, 20, dead inside and called police early Monday morning, said Richard Mongell, chief investigator for the Ashtabula County Coroner’s Office.

Mongell said the 40-year-old suffered a gunshot wound, and there were signs of trauma to the body of the 20-year-old, but “I have to wait for the autopsy” (to confirm manner of death).

The two bodies were sent to the Cuyahoga County Coroner’s Office for autopsies and the results should be in this afternoon, he said.

Ashtabula Police Chief Robert Stell said the third person, a man, was found “unresponsive” in the house and transported to Ashtabula County Medical Center, where he was treated and later released.

He is in police custody today, Stell said.

Neighbors said it was Torres’ ex-husband, Gilberto Torres, 32, was in the house when police sirens and ambulance lights lit up the neighborhood, just a short distance from Route 20 on the west side of the city.

Stell would not confirm or deny the man in custody is Gilberto Torres or whether drugs or alcohol were involved.

“(The family) hadn’t heard from the women and they wanted to know what’s going on,” Stell said. “They went over and found all this.”

Police received the emergency call at 2:17 a.m.

Neighbors, who wanted to remain anonymous for fear of retribution, said Gilberto Torres was in the house and taken away by police.

Stell said police did get a welfare check call two hours earlier, but found nothing unusual at the Kain Avenue residence to warrant kicking down the door. No outward signs of foul play, he said.

As neighbors stood outside shaking their heads Monday afternoon, one woman said, “This used to be a nice neighborhood.”

Neighbor Bill Munger said the police have been called to 5012 Kain Ave. before.

Police and neighbors said the couple have a history of domestic violence.

In 2009, Gilberto Torres was picked up during a heroin raid dubbed, Operation Blackout, according to the Ashtabula County Sheriff’s Department. The probe was led by sheriff’s detectives assigned to the Trumbull-Ashtabula group law-enforcement task force.

According to Municipal Court and Ashtabula County Common Pleas Court records, Torres has a long criminal record that includes arson, trafficking in drugs, resisting arrest, criminal trespassing, making false alarms, reckless driving, no operator’s license, aggravated disorderly conduct and criminal damaging.

He is expected to be arraigned today in Municipal Court.
