Sartini sought Yost to hand down the two-year prison terms on both involuntary manslaughter charges. Stewart in March pled guilty to the negotiated plea agreement of lesser offenses. The prosecutor’s office dismissed several other felony charges.
Sartini told Yost that Moore’s family had statements to make. Stewart’s mother also was present, but did not speak.
Moore’s mother, Lolita Moore rose slowly from the court gallery to speak. Looking at Stewart, who gazed back, the mother said tearfully, “Oh! Lord help me. This was an accident. You did not want to speed. Your mom, I can feel her pain.”
“You’ll never feel my pain of losing a child. Remorse is not going to help. I want him (Stewart) to sit down and think. I want him to pay for what he did,” she said.
The victim’s father, Tim Moore, said since losing his daughter, the couple have questioned everything they did in the short span of Latasha’s life.
“It was not our fault it happened,” he said adding how mistakes can cost a life like in this tragic case.
As the couple made their statement, Stewart bowed his head wiping tears from his eyes.
“I ask the court to be fair. We speak for my daughter, she’s not here. She’s gone ... she’s gone. Mr. Stewart you’ll have to pay for your mistakes. This is a crime,” Tim Moore said.
After sentencing, Stewart was immediately handcuffed by sheriff jail administrator, Lt. Terry Mosio and led from the courtroom. The Moore family group was ushered out first with some people sobbing. Following were a contingent of the defendant’s family and youthful friends, who also had been crying in the courtroom.
