Ashtabula man charged with 5th OVI offense

ASHTABULA TOWNSHIP — A 39-year-old Ashtabula man goes to court today to face his fifth charge of operating a vehicle while intoxicated, according to the Ohio State Highway Patrol.
Timothy R. Bennett, 3925 N. Ridge E., was cited at 8:40 p.m. Saturday after crashing his car into a utility pole on Cook Road, according to OHP reports.
He is scheduled to be arraigned at 9:30 a.m. today in Ashtabula Municipal Court.
If found guilty, Bennett will spend a minimum of 60 consecutive days and up to one year in jail, a minimum $750 fine, vehicle forfeiture and license suspension of three years up to permanent revocation, according to the Ohio Bureau of Motor Vehicles’ Web site. He also must pay for and complete a mandatory alcohol treatment program, according to the Web site.
Bennett carries a California driver’s license, OHP Lt. Mike Harman said. Although Harmon did not know when Bennett returned to Ohio, Bennett’s previous OVI convictions took place out of state, Harmon said.
In addition to four prior convictions of operating a vehicle while intoxicated, Bennett recently was found guilty of aggravated disorderly conduct, according to Ashtabula Municipal Court records. In the past, he also has been found guilty of aggravated menacing and criminal mischief, according to Ashtabula County Common Pleas Court records.
